The Chicago Police Department on Saturday took away the gun and badge of an officer who fatally shot a Black teenager he claims pointed a gun at him, CNN reports.

According to the police, the sergeant responded to a “battery in progress” call on Nov. 23. The officer, whose name was not immediately released, told investigators that 19-year-old Kajuan Raye fled when he approached the scene.

The officer said Raye pointed a gun at him twice during the chase. But investigators have not found the alleged weapon. The only known video of the incident shows Raye running but does not capture the shooting.

Chicago Police Superintendent Eddie Johnson said he has “concerns about this incident.” Johnson explained that a preliminary medical examiner’s report determined that Raye was shot in the back. The absence of a weapon and the examiner’s report influenced the decision to remove the officer from duty.

Raye’s family is “heartbroken that their son is dead at the hands of a police officer who does not value the sanctity of life of Black males,” said a statement from their attorneys, who are launching a private investigation.

A lawyer from the firm representing the family told CNN that there’s no way Raye pointed a weapon at the officer. The firm plans to ask the Cook County attorney to prosecute the officer.
