A Miami judge has ruled that the ‘stand your ground’ self defense law signed by Gov. Rick Scott a month ago is unconstitutional.

You may remember this legislation stood during the trial of Trayvon Martin as George Zimmerman’s defense, during the trial for Martin’s death.

What should be noted is that Senior Circuit Judge J. Rogers Padgett also ruled that Randolph Graham, a black man, can use the same defense during his trial in the death of ex _USF football player Elkino Watson.

The defense has been on the Florida books since 2005, but the burden of proof was recently placed on the prosecution. It was previously up to the defense to prove ‘stand your ground’ as a valid defense.

We can expect this new change to make headlines during this case as such procedural changes can be applied retroactively.
