A Ferguson, MO man is now critically injured from being shot by the police late Sunday. The police are alleging that the victim had shot at them first.

The shooting took place after a day of peaceful protests commemorating the one year anniversary of Michael Brown’s death. Shortly before the exchange, there was additional gunfire between warring groups in the middle of protests on West Florissant Avenue. The man who was shot was in one of the rival groups.

The victim had reportedly shot at the police with a stolen gun. He has not been publicly identified, nor have the police disclosed his race. However, an eyewitness, a local activist named Tony Rice, is identifying the critically injured man as Black. Rice captured the victim lying in the street in the footage below:

Hundreds gathered on the street where Michael Brown was killed by Officer Darren Wilson last August; Brown’s father later led a march for a service at a church in the neighborhood.
